Zakona o autorskom pravu i srodnim pravima (&#8220;Narodne novine&#8221; broj 111\/21.).<\/p>\n<p style=\"text-align: justify;\">Prijedlog koji se razmatrao u ustavnosudskom postupku podnijeli su 4. sije\u010dnja 2022. Udruga za za\u0161titu, prikupljanje i raspodjelu naknada fonogramskih prava i Hrvatska diskografska udruga.<\/p>\n<p style=\"text-align: justify;\">Ustavni sud u obrazlo\u017eenju me\u0111u ostalim navodi da se ne mo\u017ee govoriti o retroaktivnoj primjeni propisa jer se prethodno uspostavljeni odnosi za prethodno razdoblje ovom odredbom ne diraju. Njome se tek za budu\u0107nost, tj. za razdoblje nakon stupanja na snagu ZAPSP-a, tra\u017ei uskla\u0111ivanje postoje\u0107ih ugovora s obaveznim sadr\u017eajem iz \u010dlanka 149. ZAPSP-a.<\/p>\n<p style=\"text-align: justify;\">Prema mi\u0161ljenju odvjetni\u010dkog tima ZAPRAF-a i Hrvatske diskografske udruge, Ustavni sud nije ispunio svoju svrhu budu\u0107i da uop\u0107e nije uzeo u obzir argumente obje strane i u\u0161ao u meritum postavljenog pitanja.<\/p>\n<p style=\"text-align: justify;\">Podnositeljima prijedloga ostaje da za\u0161titu svojih prava poku\u0161aju osigurati na europskoj razini.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ustavni sud Republike Hrvatske 5. o\u017eujka 2024. godine donio je rje\u0161enje kojim se ne prihva\u0107a prijedlog za pokretanje postupka za ocjenu suglasnosti s Ustavom RH \u010dlanka 149. stavaka 3. i 4. i \u010dlanka 306. stavka 5.
